Seller Information

Buyer Information

  • The buyer refers to the party purchasing goods from Intermodal Storage Containers. If the buyer is acting outside the scope of its business activities, the consumer-related provisions apply.

Article 1: General Provisions

  1. These Terms and Conditions govern the rights and obligations arising from the purchase contract concluded between the seller and the buyer via email regarding an offer of goods displayed on our website www.intermodalstoragecontainer.com .
  2. The seller reserves the right to modify these Terms and Conditions. The version in effect at the time of the buyer’s order will apply.
  3. The purchase contract can be concluded in the Language of your choice.

Article 2: Conclusion of a Purchase Contract

  1. The seller is not obliged to enter into a purchase contract for goods presented on the website.
  2. The website includes information such as pricing and illustrative images of the goods.
  3. Buyers may request goods by completing the form or emailing the seller with:
    • Buyer’s identification details
    • Required goods and quantity
    • Delivery request
  4. A contract is concluded when both parties agree by email on:
    • Goods identification
    • Price
    • Quantity
    • Delivery method and costs
    • Delivery date
  5. Ownership is transferred to the buyer only upon full payment.

Article 3: Price of Goods and Payment Terms

  1. Payments must be made via non-cash transfer to the seller’s account.
  2. The purchase price is payable before delivery, including any agreed shipping costs.
  3. A tax document will be issued and sent electronically after payment within 14 days.

Article 4: Transportation and Delivery

  1. Goods will be delivered to the location specified by the buyer or collected in person.
  2. The buyer must ensure site readiness for delivery according to installation guidelines.
  3. A handover protocol will document the delivery, and the buyer must check goods for defects upon receipt.

Article 5: Buyer’s Obligations

  1. The buyer must conduct any necessary legal inspections before use.
  2. Ownership signs must be removed within 30 days of delivery.
  3. The buyer is responsible for all legal compliance regarding duties, taxes, and fees.
  4. Buyers must be familiar with installation and maintenance guidelines.

Article 6: Rights Based on Defective Performance

  1. The seller is liable to ensure goods are free from defects upon receipt.
  2. Specific provisions regarding defects do not apply if goods are sold at a reduced price due to known defects.
  3. The complaint procedure involves written notice to the seller, physical assessment of the goods, and notification of complaint resolution.

Article 7: Withdrawal from the Contract

  1. Consumers have the right to withdraw from the purchase contract within 14 days of receipt, with specific conditions for return shipping.
  2. Certain products cannot be returned if modified or if hygiene standards prevent resale.
  3. Gifts provided with the purchase must also be returned if the contract is withdrawn.

Article 8: Further Provisions

  1. The buyer agrees to electronic communication for contract and correspondence.
  2. The seller is not bound by any specific codes of conduct but adheres to consumer protection regulations.
  3. Discounts may not be combined on one order.

Article 9: Final Provisions

  1. Email arrangements take precedence over these Terms and Conditions.
  2. Unregulated matters are governed by the Civil Code.
  3. International agreements will be governed by United States of America laws, with disputes adjudicated by American courts.
